India’s recent take on Data Protection Law has not only widened the scope of privacy laws, which busted out from the K.S. PUTTASWAMY case but also regulated various aspects of Digital platforms that are directly or indirectly consuming data of individuals. As technological developments are taking rapid growth in Indian culture, the role of AI (Artificial Intelligence) has overlapped the data protection laws in India.
It has been
observed that it took some time for the Indian Government to inculcate Data
Protection laws as compared to other countries, but Indian Data
Protection Laws follow, the European Union's GDPR, which is one of the best models
of data protection laws dealing with various aspects of privacy rights. This is not
only a welcoming step from the government but also stands still with the
upcoming challenges like AI.
Artificial Intelligence, on the one hand, proves to be
a useful tool to make things easier but also has serious repercussions on of personal data of individuals as AI uses data without having proper
consent from the individuals which could be dangerous for ethical as well as
societal points of view.
Hence, regulating rules and laws which can counter the
misuse of AI keeping in mind the objectives of implementing Data protection
laws will have to be taken into consideration as soon as possible.
